General Terms and Conditions (Terms)
This is a convenience translation. The German version is legally binding. German version as of 6 October 2026.
TravelMaster Go · As of: 24 October 2026
§ 1 Scope and provider
(1) These Terms apply to the use of the mobile application “TravelMaster Go” (hereinafter “app”) and of the online services associated with it, offered by Thomas Althaus, In der Rötelgrube 2, 74243 Langenbrettach (hereinafter “provider”).
(2) The version of these Terms valid at the time of use is authoritative. Deviating terms of the user are rejected.
(3) The app is aimed at consumers and traders (Unternehmer) in the DACH region (Germany, Austria and Switzerland).
§ 2 Definitions
- “User” means any person who uses the app.
- “Account” means the optional user account; anonymous use is possible alongside it.
- “Subscription” means the paid features (Premium / Premium+).
- “Content” means contributions, tips, reviews, photos and the like posted by the user.
§ 3 Subject matter of the contract and services
(1) The app provides support with trip planning and organisation, including: creating and managing trips, discovering places/activities in the surrounding area, map and offline features, packing and document management, trip cost/budget features and an AI assistant (“Coco”).
(2) The provider makes available a free basic scope as well as paid additional features (§ 5). There is no entitlement to a specific, unchanged range of features (§ 12).
(3) Parts of the content displayed, in particular location, event, weather and traffic data, originate from publicly accessible sources or from third-party providers. The provider selects these sources carefully, checks them technically and updates them regularly; nevertheless, it cannot be ruled out that individual details are incomplete, delayed or incorrect. Time-critical or safety-relevant information must be verified against a current official source before it is used. Warranty (Gewährleistung, the statutory rights in respect of defects) is governed by § 13, liability by § 14; the cases of unlimited liability provided for there remain unaffected.
§ 4 User account and registration
(1) The app can be used anonymously. An account is required for certain features; it can be created by email, Apple sign-in or Google sign-in.
(2) Minimum age for use: 16 years. Younger persons may use the app only with the consent of a person with parental responsibility; that person’s approval is required in any case for paid services and for publishing one’s own contributions. The age rating in the app stores assesses the suitability of the content and is independent of this: the minimum age of 16 years results from the fact that, in Germany, consent to the processing of personal data can be given by the person themselves from that age (Art. 8 of the General Data Protection Regulation, GDPR) and that contracts require legal capacity (Geschäftsfähigkeit).
(3) When registering, the user provides truthful information and keeps their access data secret.
§ 5 Subscriptions, prices and payment
(1) The following tiers exist: Free (free of charge), Premium, Premium+ and a one-off Lifetime licence (see § 5a). The prices, billing periods and scopes of service applicable in each case are displayed in the app and during checkout in the respective app store. Solely the final price displayed there immediately before the order is placed is authoritative — it may differ depending on country and currency. For purchases via the Apple App Store or Google Play, the store operator acts as the merchant and itself shows the taxes applicable there. For services that the provider bills directly (currently: the printed photo book under § 8a), § 19 Umsatzsteuergesetz (UStG, German VAT Act) applies — no value-added tax is charged or shown.
(2) Purchase and billing take place via the respective app store (Apple App Store or Google Play). The terms of the respective store operator apply in addition; payment processing is the responsibility of that operator.
(2a) Contracting party and responsibility. Depending on the app store used, the country of residence and the type of transaction, the store operator may act as seller, merchant, intermediary or payment service provider; the information of the app store displayed at the time of purchase is authoritative. Irrespective of payment processing, the provider remains responsible for the features, content and digital services it provides, unless a third party is expressly identified as the supplier of the service.
For users, this means: cancellation, refunds and payment issues must be asserted via the account of the respective app store (§ 8); claims for defects of the app itself are to be addressed to the provider. Services that the provider bills directly — currently exclusively the printed photo book under § 8a — are contracted directly with the provider; the separately displayed payment and withdrawal terms apply there. Statutory claims against the respective responsible contracting party remain unaffected.
(3) Subscriptions (Premium and Premium+) renew automatically for the chosen term unless they are cancelled in good time (§ 8).
(4) Price changes for ongoing subscriptions are announced in good time before they take effect. They take effect only if the user consents to them; mere continued use does not constitute consent. For subscriptions running via the Apple App Store or Google Play, the announcement and consent take place via the procedures provided for this purpose by the respective store operator. If the user does not consent, the subscription continues on the previous terms until the end of the current period and does not renew.
§ 5a Lifetime licence
(1) The “Lifetime licence” grants, in return for a one-off payment, a non-transferable right of use, unlimited in time, to the then-current feature set of the Premium+ tier — namely for the lifetime of the product “TravelMaster Go”, not for the lifetime of the user. For AI features, the rules in paragraph (2a) apply instead; the AI model is that of the Premium tier.
(2) The licence covers future feature updates of the app within the scope of the Premium+ tier. There is no entitlement to specific individual future features. Future, separately priced add-on products (e.g. printed photo books) are not included. The purchase is tied to the app store account and can be activated on further devices via “Restore purchases”.
(2a) AI features. The licence includes 600 AI actions per usage year. The first usage year begins on the day of purchase, each further one on the anniversary. Unused AI actions are carried over to the next usage year; at the start of a usage year, no more than 1,200 AI actions are available. No more than 30 AI actions are possible per calendar day. An AI action is any request with which the user triggers an AI feature (e.g. a question to Coco, a trip plan, a receipt scan); notices that the app creates without the user’s involvement do not count. In addition, the monthly limits of the Premium tier apply: no more than 30 scans (e.g. receipts, documents, bookings) and AI tips for no more than 5 cities per calendar month; each such use also counts as an AI action. Days, months and anniversaries follow Coordinated Universal Time (UTC); in Germany the day therefore changes at 1 a.m., or at 2 a.m. during summer time. The app shows the balance under “My AI allowance”.
(2b) Once the AI actions are used up, all other features remain fully usable. Further AI actions are available from the next anniversary. The provider may increase the number of AI actions; a reduction compared with paragraph (2a) is excluded, including under § 17. If the user additionally takes out a Premium+ subscription, the Premium+ rules also apply to AI features for its term; the AI actions of the Lifetime licence are not used during this time, while anniversaries and carry-over continue to run.
(3) The provider ensures the operation of the app for a period of at least 36 months from the purchase of the Lifetime licence. Should the service be discontinued thereafter, the provider will give notice at least six months in advance in the app and, if an email address is on file, by email. If the provider discontinues the service before these 36 months have expired, it will refund the user one thirty-sixth of the purchase price paid for each full month remaining. A right of use granted for an unlimited period does not carry any guarantee that all features will remain compatible indefinitely with all future devices, operating systems and third-party services; for the provision of updates, see § 13a.
§ 5c Founder campaign “The first 100”
From the start of the Founder campaign, the first 100 accounts for which a Premium yearly subscription is paid for the first time receive Founder status with a consecutive Founder number (#001 to #100). What counts is the time of the first payment as reported to the provider by the app store; a free trial does not count, but the first payment after it does. The spot is assigned to the TravelMaster Go account the user is signed in with at the time of purchase. Monthly subscriptions, Premium+ subscriptions, the Lifetime licence, switching from an ongoing subscription to the Premium yearly subscription and subscriptions paid before the start of the campaign do not confer Founder status.
There are exactly 100 Founder numbers. A number once assigned is never reassigned, not even after cancellation, a refund or deletion of the account. If all numbers have already been assigned at the time of the user’s first payment, the subscription continues without Founder status on the terms shown at purchase; there is no entitlement to a spot. During the campaign, the app shows how many spots have actually been assigned.
Founder status is tied to the user’s TravelMaster Go account, not to a device or an app store account, and remains in place even if the subscription ends. It comprises the Founder number, the Founder badge, which the user can show or hide in the settings, the “Founder” colour scheme and the benefits set out in the following paragraphs. Premium features still require an active subscription. Founder status ends when the account is deleted; the number remains assigned without any link to the user.
Price guarantee. For the Premium yearly subscription with which the user became a Founder, the provider will never charge more than the price at which it was taken out, as long as the subscription continues without interruption. The guarantee applies to the price in the country and currency of the app store in which the subscription was taken out. Termination by the provider under § 17(4) for the purpose of a price increase is excluded.
Founder page. The provider makes a Founder page available in the app listing the assigned Founder numbers. The user’s name appears there only if they enter it themselves and expressly agree to its publication; otherwise only their number is shown, for example “Founder #042”. The user can change or remove the name at any time; it then disappears from the Founder page. The provider may remove names that violate § 9 or § 10 or infringe the rights of third parties.
Participation. The provider invites Founders to vote on planned features and to contribute suggestions. It announces the format and timing in the app. There is no entitlement to the implementation of any particular suggestion.
“Permanent” and “lifelong” in this section refer to the lifetime of the TravelMaster Go service, not to the lifetime of the user.
Price, renewal and cancellation of the subscription are governed by § 5 and § 8; the price is shown in the app store before purchase. The right of withdrawal is governed by § 7.
§ 6 Free trial period
(1) A free trial period may be offered for paid tiers. Whether a trial exists and how long it lasts is shown during checkout in the respective app store before the order is placed; only that information is authoritative. There is no entitlement to a trial period.
(2) If the trial period is not cancelled before it expires, it converts into a paid subscription on the terms displayed during checkout. Cancellation is made via the account settings of the respective app store (§ 8). The respective store operator provides notice of the upcoming conversion in accordance with its own procedures.
§ 7 Right of withdrawal (consumers)
Instructions on withdrawal
The wording of the instructions is prescribed by law (Annex 1 to Article 246a of the Einführungsgesetz zum Bürgerlichen Gesetzbuch – EGBGB, Introductory Act to the German Civil Code). It is reproduced here unchanged (in the German original, the formal form of address (Sie) is therefore used here). The start of the period differs depending on the service.
a) Digital content and services
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.
b) Printed photo book (goods) — no right of withdrawal
There is no right of withdrawal for the printed photo book, because it is made to your individual specifications and is clearly tailored to your personal needs (§ 312g(2) no. 1 Bürgerliches Gesetzbuch (BGB, German Civil Code)). This exclusion is pointed out during checkout directly above the order button, before the order is placed. Details in § 8a(5).
Should goods that are not made to individual specifications be offered in future, the statutory withdrawal period of fourteen days from the day on which you, or a third party other than the carrier and indicated by you, have taken possession of the goods applies to such goods.
Exercise (for both cases)
To exercise the right of withdrawal, you must inform us (Thomas Althaus, In der Rötelgrube 2, 74243 Langenbrettach, Germany, service@travelmaster-go.app) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
For goods with a right of withdrawal, the following applies in addition — for the printed photo book, there is no such right under letter b): We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Early expiry of the right of withdrawal
For a contract for the supply of digital content or digital services not supplied on a tangible medium, the right of withdrawal expires if we have begun performance after you have given your express consent to performance beginning before the end of the withdrawal period and have acknowledged that you thereby lose your right of withdrawal upon commencement of performance (§ 356(5) BGB). We obtain both separately before the purchase; you subsequently receive a confirmation by email.
No right of withdrawal for goods made to specification
The exclusion for the printed photo book is set out above under letter b) — where the period would otherwise be stated. Details in § 8a(5).
Purchases via an app store
Where subscriptions or rights of use are purchased via the Apple App Store or Google Play, the respective store operator acts as the merchant. Withdrawal and refunds are then governed by its procedures and must be claimed directly there; statutory rights against the respective responsible contracting party remain unaffected.
Model withdrawal form
If you wish to withdraw from the contract, you can complete this form and return it to us. Its use is voluntary.

§ 8 Term and cancellation
(1) Paid subscriptions can be cancelled at any time with effect at the end of the current billing period via the app store account.
(2) When the cancellation takes effect, access to the paid features ends at the end of the period.
§ 8a Ordering printed products (photo book)
(1) Photo books and other printed products are offered via a separate ordering process (not via the app stores); the contracting party is the provider. Production and shipping are carried out by the commissioned print service provider Gelato ASA, Dronning Eufemias gate 8, 0191 Oslo, Norway, usually via local print partners in the country of delivery.
(2) The contract is concluded upon the provider’s order confirmation. Before the order is placed, the essential characteristics, the total price and the shipping costs are displayed as a separate item (button labelled “zahlungspflichtig bestellen” [order with obligation to pay], § 312j(3) BGB). The total amount displayed is the amount that will be charged. Pursuant to § 19 UStG, no value-added tax is charged or shown.
(3) Shipping and shipping costs. Production and shipping usually take place within 5–10 working days of receipt of the order. Delivery is made exclusively to Germany, Austria and Switzerland; orders with a delivery address in another country cannot be accepted. Within Germany, shipping is included in the price; for deliveries to Austria and Switzerland, shipping costs of €5.00 are charged.
(4) Delivery to Switzerland. Switzerland is not part of the customs territory of the European Union. Customs duties and import charges may be incurred on import; they are not included in the price and are to be borne by the recipient. This circumstance is additionally pointed out immediately before the order is placed.
(5) No right of withdrawal. The photo book is produced according to the user’s individual specifications (own photos, texts and design). The photo book is therefore goods produced to customer specifications, for which the right of withdrawal does not exist under § 312g(2) no. 1 BGB. The exclusion is pointed out during checkout directly above the order button, before the order is placed.
(6) The statutory warranty rights for goods apply.
(7) Product safety and manufacturer information. The manufacturer within the meaning of Regulation (EU) 2023/988 on general product safety is Gelato ASA, Dronning Eufemias gate 8, 0191 Oslo, Norway. The responsible person in the European Union and the contact for questions on product safety is the provider: Thomas Althaus, In der Rötelgrube 2, 74243 Langenbrettach, Germany, service@travelmaster-go.app. Please send safety-related information or complaints to this address; we will forward them to the manufacturer where necessary.
(8) Photo books consist of printed paper and cardboard. They are not a toy — please keep away from children under three years of age, as individual parts could become detached and be swallowed. Not intended for contact with food.
§ 9 User content
(1) Users can post content (e.g. ideas/feedback, tips, contributions, photos). The user remains responsible for their own content and warrants that they hold the necessary rights.
(1a) Photos: checked using an automated process. Photos associated with a location are automatically checked before publication (for offensive content, recognisable faces, legible number plates) and are then displayed immediately. Human review takes place on a case-by-case basis — particularly following a report. If a photo is reported, it is immediately hidden from view.
(1a bis) Approval requirement for texts. Free-form texts and insider tips continue to be reviewed without exception before publication. Until then, they are visible only to the person who posted them. The review may take a few days. There is no entitlement to publication; if approval is refused, paragraph (4c) applies accordingly.
(1b) Photos. Only one’s own photographs or those for which express permission has been given may be posted. If persons are recognisably depicted, their consent is required (§ 22 Kunsturhebergesetz (KunstUrhG, Act on Copyright in Works of Art and Photography), Art. 6(1)(a) of Regulation (EU) 2016/679); in the case of minors, that of the persons with parental responsibility. Images on which vehicle registration plates, identity documents, tickets, invoices or other personal details of third parties are legible may not be posted, nor may images of third-party works insofar as their reproduction is not permitted. Location data is automatically removed from the image file during upload, before the photo is saved.
(1c) Publishing a travel diary. If a travel diary is published, it can be accessed by anyone — not only by selected recipients and regardless of whether a link has been shared. Before publication, it must be checked whether entries, names or photos concern other persons; such details may only be published with their consent. Publication can be withdrawn at any time in the app; pages already accessed may remain in caches for a short time.
(2) Grant of rights. The rights in the content remain with the user. So that a contribution can be displayed at all, by posting it the user grants the provider a simple (non-exclusive), royalty-free right of use: the provider may make the content publicly accessible in the app and on the associated website, store and reproduce it for that purpose, and process it technically for display (resizing, compression, cropping, removal of location data from photos). The right of use expressly also covers reproduction in previews, result lists and search results, as a thumbnail and in trip links that the user has shared themselves — in each case only for as long as, and to the extent that, the content is intended to be displayed there. The right of use does not permit any use beyond displaying the content in the app and on the website — in particular no advertising with user content and no transfer to third parties for their own purposes. It ends upon deletion of the content; technically required retention periods are described in the privacy policy.
(2a) Because the right is non-exclusive, the user may continue to dispose freely of their content — publish, sell or license it elsewhere. Not covered is any use outside the app and the website, in particular in advertising, store images, ads or social networks; for this, the user will be asked beforehand. No sublicensing to third parties takes place. Other users acquire no rights to the contribution; they may only view it in the app and on the website.
(2b) End of the right of use. If the user deletes a contribution or their account, the right of use ends and the content is removed — including from the public areas. For technical reasons, it may still be briefly accessible from caches (content delivery network, up to one hour) and from routine backup copies until these are overwritten as scheduled. Irrespective of this, content may be retained further where there is a statutory obligation or where it is needed to pursue or defend legal claims.
(3) Unlawful, offensive or misleading content, or content infringing the rights of third parties, is prohibited. The provider may remove such content.
(4) Reporting unlawful content (Art. 16 DSA). Users and third parties can report to the provider content they consider unlawful — in the app via the reporting function on the individual contribution, via the contact form or by email to service@travelmaster-go.app.
(4a) The report should contain: an explanation of why the content is considered unlawful, the exact location of the content (in the app, reporting it on the contribution itself is sufficient), a means of contacting the reporting person and a statement that the information is accurate and complete to the best of their knowledge. A report is also possible without contact details; in that case, however, the provider cannot inform the reporting person of the outcome.
(4b) The provider confirms receipt without undue delay: when reporting in the app, a case number is displayed immediately; where an email address is available, a confirmation is additionally sent. The provider reviews the report promptly and diligently and informs the reporting person of the decision, stating the reasons (Art. 16(5) DSA).
(4c) Where a contribution is removed or disabled, the person who posted it receives a statement of reasons covering the scope and duration of the measure, the facts relied on, whether automated means were used, the legal or contractual grounds, and the available redress (Art. 17 DSA). The decision can be contested informally at service@travelmaster-go.app; independently of that, out-of-court dispute settlement under Art. 21 of Regulation (EU) 2022/2065 and judicial redress remain available.
(4d) Automated measures (Art. 14(1) DSA). If several different persons report the same contribution, it may initially be hidden automatically — from two reports for community contributions, from three for event listings. This measure is based solely on the number of distinct reports and not on a review of the content. The person who posted it is informed of this, with reasons, and can object; a human then reviews the case. Community contributions undergo the prior review under paragraph (1a) in any case. Automatic removal solely on the basis of reports does not take place for place contributions (pins).
§ 9a Blocking and measures in case of violations
(1) Blocking by the user. Users can block other users. Their contributions will then no longer be shown to them. The block applies only to the blocking user, can be revoked at any time and is not communicated to the blocked person.
(2) Measures taken by the provider. In the event of a violation of these terms, the provider may, depending on severity and repetition, point out the violation, remove or disable individual content, suspend the community features temporarily or — in the case of serious or repeated violations — suspend them permanently. A temporary suspension lasts 7 days as a rule and 30 days in the event of repetition; it ends automatically, without any action on the part of the user. A permanent suspension requires a serious violation or a renewed violation after a 30-day suspension. The provider chooses the mildest suitable measure and takes the user’s interests into account.
(3) What a suspension does not affect. A suspension of the community features does not affect services purchased for a fee; the user’s own travel data remains accessible and exportable. In the case of a permanent suspension due to serious violations, the provider may additionally terminate the contract for good cause (§ 314 BGB); services paid for in advance and not used will be refunded pro rata.
(4) Statement of reasons and objection. The provider notifies the user of a measure and gives reasons for it. The user may object to it by email to service@travelmaster-go.app; the provider reviews the objection and communicates the outcome (Art. 17 and 20 of Regulation (EU) 2022/2065 [Digital Services Act]). Where there is imminent danger, action may be taken first and the reasons provided subsequently without undue delay.
§ 9b Affiliate links
(1) Certain references to third-party providers are affiliate links: if a booking is made via such a link, the provider may receive a commission. The price for the user does not change as a result. Affiliate links are labelled in the app directly at the respective link.
(2) The contract for the respective service is concluded exclusively between the user and the third-party provider under the latter’s terms. The provider is not responsible for the performance of such contracts unless it expressly acts itself as the supplier of the service in question. For the data protection aspects, see the app privacy policy.
§ 10 Rules of use
Prohibited in particular are: abusive use, automated extraction of data, circumvention of protective measures, impairment of availability and any unlawful use.
§ 11 AI features (“Coco”)
(1) The app contains AI-assisted features. AI-generated answers may be incorrect, incomplete or out of date.
(2) They do not constitute professional, legal, medical or safety-related advice. Important details (e.g. opening hours, prices, safety/health information) must be verified on one’s own responsibility.
(3) “Coco” is an AI system. This is pointed out in the app on first contact (transparency obligation under Art. 50 of Regulation (EU) 2024/1689 [AI Act], applicable from 2 August 2026).
(4) Details on the processing of your input by commissioned AI service providers are set out in the privacy policy.
(5) Reporting AI output. If an AI feature produces content that you consider offensive, misleading or inappropriate, you can report it directly in the app — via the reporting function on the respective output. The report reaches the provider without any detour via other channels. What is transmitted is the output complained of and the reason you selected, not your input. The provider evaluates incoming reports in order to improve the filtering and moderation of the AI features.
(6) Usage limits. AI features are subject to limits per tier — a number per day and, for individual features, per month. They are shown before purchase on the payment page of the app; the app shows today’s usage under “My AI allowance”. For the Lifetime licence, § 5a governs the limits. Once a limit is reached, all other features remain usable.
§ 12 Availability and changes to the service
(1) Uninterrupted availability is not owed (e.g. maintenance, disruptions of external services).
(2) The provider may further develop or adapt the service or change/discontinue individual features insofar as this is reasonable for the user.
§ 13 Warranty
The statutory provisions apply. For digital products provided against payment, § 13a applies in addition.
§ 13a Updates and technical requirements
(1) During the statutorily relevant period, the provider supplies updates necessary to maintain the app’s conformity with the contract and its security (§ 327f BGB). These may include, in particular, security updates, bug fixes and adaptations required for continued use on supported operating systems.
(2) Information about necessary updates and the possible consequences of failing to install them is provided in a suitable manner — within the app, via the respective app store or by email.
(3) The user is responsible for installing supplied updates within a reasonable period and for using a supported operating system and a functioning internet connection. If the user fails to install an update despite its proper provision and despite having been informed, the statutory rules on responsibility for defects resulting from this apply.
(4) The provider may discontinue support for technically outdated operating system versions where continued support is no longer reasonable due to missing security updates, changed interfaces, disproportionate effort or other significant technical reasons. Users will be informed of this in good time. Mandatory statutory rights remain unaffected.
(5) For subscriptions, necessary updates are generally provided for the duration of the ongoing contractual relationship. For rights of use granted for an unlimited period (§ 5a), the period is governed by the statutory provisions and the circumstances of the contract.
§ 14 Liability
(1) The provider is liable without limitation for intent and gross negligence, for culpable injury to life, body or health, under the provisions of the Produkthaftungsgesetz (German Product Liability Act), to the extent of an expressly assumed guarantee, and in other cases of mandatory statutory liability.
(2) In the event of a slightly negligent breach of a material contractual obligation, the provider is liable only for the damage typical for this type of contract and foreseeable at the time the contract was concluded. Material contractual obligations are those whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the contractual partner regularly relies and is entitled to rely.
(3) Otherwise, liability for damage caused by slight negligence is excluded. The cases of unlimited liability under paragraph (1) — in particular for intent and gross negligence, for injury to life, body or health and under the Produkthaftungsgesetz — remain unaffected by this.
(4) Emergency and safety information. In emergencies, the official emergency number applicable at the place of stay or the competent local authority must be contacted immediately. Within the European Union, the European emergency number 112 is generally available; local particularities and additional emergency numbers may exist. The emergency numbers and safety notices shown in the app are a supporting information feature. They must not be used as the sole basis for a specific emergency decision. The app is not an emergency call service, emergency dispatch centre or medical advisory service. Time-critical or safety-relevant information must be verified against a current official source before it is used; for each emergency number, the app states the source and the date of the last check.
(5) Accessibility information. Information on the accessibility of places, for example for wheelchairs, comes mainly from OpenStreetMap and from other users. The provider does not check it on site. The user should clarify any requirements they depend on directly with the place or provider before the visit.
§ 15 Intellectual property
The app, software, trademarks, texts, graphics and other content of the provider are protected by law. Any use beyond use in accordance with the contract requires the provider’s consent.
§ 16 Data protection
Information on the processing of personal data is contained in the app privacy policy: https://travelmaster-go.app/en/app-privacy.html.
§ 17 Changes to these Terms and to the app
(1) Editorial changes. The provider may amend these terms without users’ consent insofar as only typographical errors, obvious inaccuracies, contact details or comparable editorial points are corrected and neither the substance of the contract nor users’ rights or obligations change as a result.
(2) Changes for compelling reasons. The provider may adapt contractual terms insofar as this is necessary to implement mandatory statutory or regulatory requirements, to take account of a binding court decision, to eliminate security risks, to prevent misuse or fraud or to make technically necessary changes, and the change is reasonable taking the users’ interests into account. Users are informed of such changes in good time and in comprehensible form; where the change impairs the possibilities of use more than insignificantly, notice is given on a durable medium, for example by email.
(3) Material changes. Changes affecting in particular the price, the main performance obligations, the contract term, rights of cancellation or material rights of use only take effect if the user expressly consents to them or a statutory basis permits the change without consent. Mere continued use of the app does not constitute consent.
(4) Consequences of consent not being given. If a user does not give the consent required for a material change, the existing contract generally remains unchanged. Where continuing the contract on the existing terms is objectively no longer possible or is unreasonable for the provider, the provider may terminate the contract for the future in compliance with the contractual and statutory requirements. Rights already acquired, in particular paid and permanently granted rights of use (§ 5a), remain unaffected unless mandatory statutory or technical reasons preclude this.
(5) Changes to the app’s features are made in accordance with the statutory provisions, in particular § 327r BGB. Users are informed in good time, in clear and comprehensible form and on a durable medium, of changes that impair the ability to access or the usability more than insignificantly.
§ 18 Consumer arbitration
The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 19 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the state in which they have their habitual residence. For users in Austria and Switzerland, the mandatory consumer protection provisions applicable there remain unaffected.
(2) Consumers: The statutory places of jurisdiction apply. No exclusive jurisdiction agreement is made in relation to consumers.
(2a) Traders: If the user is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is — to the extent permitted by law — the provider’s place of business.
(2b) For users without a general place of jurisdiction in Germany, a jurisdiction agreement applies only insofar as it can be validly agreed under the applicable statutory provisions.
(3) Should any provision be invalid, the validity of the remaining provisions shall remain unaffected.
